Spaan, who owns about 20 properties in Henrietta, was issued a notice of violation by the town building inspector earlier this year. Spaan was cited for violating the ordinance, and he appealed his notice of violation to the town zoning board last month. The decision regarding Spaan's appeal — not the validity of the law itself — was postponed until Wednesday night. While Spaan himself has called the law discriminatory against students, that would more likely be decided by a judge if Spaan decides to file a lawsuit.
